TERMS AND CONDITIONS OF SALE IN THE ONLINE STORE:
§1 General provisions
The online store available at www.adventures-after-work.pl/poradniki is operated by Tomasz Prochwicz Pienista 51D/23 94-109 Łódź, NIP: 7722317483 on the terms and conditions specified in these Regulations. Having e-mail address: adventures.after.work@gmail.com. Hereinafter referred to as the Seller.
Acceptance of the Terms and Conditions is voluntary, but necessary to place an Order.
§2 Definitions
Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order from the Store.
Civil Code – the law of April 23, 1964 (Journal of Laws 1964 No. 16, item 93 as amended).
Regulations – these Regulations for the provision of electronic services in the online store www.adventures-after-work.pl/poradniki
Adventures-After-Work online store – the Internet service available at www.adventures-after-work.pl/poradniki, through which the Customer can, in particular, place Orders;
Goods – products presented in the Online Store.
Contract of sale – a contract for the sale of Goods within the meaning of the Civil Code, concluded between Adventures-After-Work Tomasz Prochwicz and the Customer, concluded using the Store’s website.
Law on Consumer Rights- Law of May 30, 2014. On consumer rights (Journal of Laws 2014, item 827 as amended).
Order – a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.
Guidebook – should be understood as a book in electronic version, i.e. the so-called e-book. The content file containing such a book can be saved in PDF format.
Copyright – shall be understood as the Law of February 4, 1994 on Copyright and Related Rights.
§3 General provisions
These Regulations define the rules of using the online store available at www.adventures-after-work.pl/poradniki.
The online store, operating at www.adventures-after-work.pl/poradniki, is operated by Adventures-After-Work Tomasz Prochwicz, Pienista 51D/23 Street, 94-109 Lodz, NIP: 7722317483.
These Regulations define in particular:
a) principles of registration and use of an account as part of the online store,
b) terms and conditions for electronic reservation of products available as part of the online store,
c) terms and conditions for electronic placement of Orders as part of the online store,
d) principles of concluding Sales Agreements with the use of services provided as part of the Online Store.
§4 Rules of using the online store
Making a purchase of a Product does not require registration in the Store.
Information provided on the websites of the Store, including information about the presented products, and in particular their descriptions, technical and usable parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
Placing an order is done using a form, available on the website of the Store.
Each customer placing an order agrees to receive information related to the course of the transaction, notifications of changes in these Regulations to the e-mail address provided by the customer.
In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.
The Seller takes measures to ensure the fully correct functioning of the Store. The Buyer should inform the Seller about any irregularities or interruptions in the functioning of the Store.
It is forbidden to use any materials published on the Store website (including photos and product descriptions) without the written consent of the Store.
§5 Conclusion of sales contract
In order to carry out any activity of the Customer in the Store, it is required to properly operate the Internet, use a web browser, including within the framework of mobile devices, and have an active account on the selected e-mail address.
In order to conclude a Sales Agreement through the Online Store, you need to enter the website www.adventures-after-work.pl/poradniki, make a selection, taking further technical actions based on the messages displayed to the Customer and the information available on the website.
The Store allows you to purchase products and services 24 hours a day, 7 days a week. The execution of the order will be carried out within 48 hours from the moment the payment is credited to the Seller’s account.
The selection of the ordered Goods by the Customer is made by adding them to the shopping cart.
During the placement of the Order – until the moment the “Place Order” button is pressed – the Customer has the possibility to modify the entered data and in the selection of the Goods. In order to do so, the Customer should follow the messages displayed to him/her and the information available on the website.
In order to finalize the order, the Customer is asked to provide all the necessary data needed to complete the order, i.e.
a) name / company name
b) e-mail
c) contact phone
d) address – in case of a request for a VAT invoice
e) VAT ID – in case of a request for a VAT invoice.
After the Customer using the Online Store has provided all the necessary data, a summary of the placed Order will be displayed. Summary of the Order placed will contain information on:
a) subject of the order,
b) unit and total price of the ordered products or services,
c) selected method of payment,
d) selected method of delivery.
In order to send the Order it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the “Place Order” button.
Sending an Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with Adventures-After-Work Tomasz Prochwicz, in accordance with the content of the Regulations.
After placing an Order, the Customer receives an e-mail message entitled “ADVENTURES AFTER WORK -” together with an order number, containing a final confirmation of all important elements of the Order. In order to conclude the contract, payment must be made.
The contract is considered concluded at the moment when the Seller receives the payment for the order indicated in the email above.
The sales contract is concluded in Polish, with the content in accordance with the Regulations.
§6 Delivery of orders
Prices of products in the Store are given in Polish zloty, and include tax excluding shipping costs. Delivery of Products containing digital content is made via the Internet and is free of charge. At the express request of the Client, a VAT invoice may be issued. The download of the product will be possible for 7 days after the dispatch of the guide by the Seller with the possibility of extension after prior contact with the Seller.
§7 Prices and payment methods
The prices of the Goods are given in Polish zloty and include all components, including VAT. The Customer has the option to pay by traditional transfer, BLIK on the phone or the Przelewy24 portal.
After receiving information about the payment made, the Seller sends information about the receipt of the payment to the e-mail address provided by the Buyer, along with information about how to download the Products.
In case the payment for the e-book is not received on the Seller’s account indicated on www.adventures-after-work.pl within 14 days from the receipt of the order by the Seller, it means that the order has been cancelled by the Customer and is treated as not submitted.
§8 Guidance License.
The Guidebook offered by the Seller constitutes a work within the meaning of the Copyright Law, and thus is protected by this law.
(1) The copyright of the guide is vested exclusively in the Seller.
(2) As of the date on which the Vendor sends the tutorial to the Customer’s e-mail address specified in the order, a license to use the ordered tutorial covered by its content is granted to the Customer who placed the order, to the extent specified in the Terms and Conditions.
3. license for use of the purchased guide :
– allows use only by the Customer, to whom this license was granted, for his own internal use.
(4) The customer is not entitled to: distribute or share the purchased guide, its fragments, its copies, use it / its copies for commercial purposes, make changes or any kind of modification or deletion of errors.
(5) The content of the guide is copyrighted by the Seller and it is forbidden to distribute its content, share it with other people and entities without the consent of the Seller, post it on online forums and social networks.
(6) A customer who has purchased a guide shall not be entitled to grant further licenses to use it.
(7) The customer shall ensure that no other unauthorized person uses the guide purchased by him.
§9 Technical requirements
Use of the guide requires a device capable of reading PDF (Portable Document File) format and a storage capacity of at least 1024 MB.
§10 Termination of contract
If the Customer places an order and the Seller receives this order, a contract is concluded on the terms and conditions set forth in the Terms and Conditions, provided that the Customer makes payment in accordance with these Terms and Conditions.
Unilateral termination of the contract by a Customer who does not have the status of a Consumer is governed by applicable laws, with the proviso that such a Customer may not withdraw from the contract or otherwise terminate the contract once he has received the purchased guide.
The Consumer has the right to cancel the order until the Vendor sends the guide by sending the information “I cancel the order” to: adventures.after.work@gmail.com with the name of the Customer, the order number and his/her email address
. In such a case, the Seller will refund the Customer the funds paid.
§11 Cancellation of Customer’s Contract
A customer with the status of a Consumer, by placing an order for the purchase of a guidebook, thereby consents to the commencement of the performance of the service covered by its subject before the expiration of the deadline for withdrawal from the contract.
The right to withdraw from the contract does not apply to the Customer with respect to the contract for the provision of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the consumer before the expiration of the deadline for withdrawal from the contract and after the Seller has informed him of the loss of the right to withdraw from the contract (in accordance with Article 38 of the Act of May 30, 2014 on
consumer rights – consolidated text of June 24, 2014, Journal of Laws of 2020, item 287).
§12 Liability for defects
The Client has the right to make a complaint by e-mail to the e-mail address adventures.after.work@gmail.com with the annotation “complaint” in particular when :
– the electronic guide proves to be damaged or the download link expires,
– within 48 hours from the moment of providing the Vendor with a confirmation of payment, the Client does not receive the guide at the e-mail address provided by the Client.
The complaint should include, in particular, a description of the problem that the Client reports, the Client’s name and surname, the date of the order, as well as the method of contact with the Client (e-mail address, telephone number). The Seller reserves the right to contact the Customer using the contact information provided by the Customer. The complaint will be resolved within 48 hours from the moment of proper notification. Complaints submitted after one year from the date of delivery of the guide to the Client , are not subject to consideration.
§13 Personal data and cookies
The administrator of your personal data is the Seller.
Your personal data will be processed in accordance with applicable laws, including in particular the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as “RODO”.
Your personal data will be processed:
on the basis of Article 6(1)(b) RODO – for the purpose of performing the contract linking the Administrator with you, including making payments, handling complaints, withdrawing from the contract, responding to e-mail inquiries and contacting you, including for purposes related to the performance of the contract – until the statute of limitations for claims arising from the contract,
on the basis of Art. 6(1)(c) RODO – for the purpose of fulfilling a legal obligation incumbent on the Administrator, i.e. for tax and accounting purposes – until the expiration of the statute of limitations for tax liabilities, unless otherwise provided by tax laws,
on the basis of art. 6(1)(a) RODO – for the purpose of marketing its own products and services using electronic communication means – until you withdraw your consent,
on the basis of art. 6(1)(f) RODO, i.e. the Administrator’s legitimate interest in handling requests made using the contact form, asserting claims related to the concluded agreement, keeping statistics – until the statute of limitations for claims under the agreement, and also for a period of 1 year to maintain accountability.
In order to finalize the purchase in the Store it is necessary to provide all the Customer’s data required by the content of the form and to check the appropriate box concerning the confirmation of acquaintance and acceptance of these Regulations.
All Customer’s data provided during the registration in the Store will be used only for the purpose of realization, modification or termination of the Agreement.
All personal data of the Customer will be processed by the Owner in accordance with the content of the Act referred to above.
The administrator of the Customer’s personal data is Adventures-After-Work Tomasz Prochwicz Pienista 51D/23 Street, 94-109 Lodz, NIP 7722317483.
Only personal data provided voluntarily by the Customer are collected. The data are processed for the purpose necessary to perform the provisions of these Terms and Conditions, in particular to conclude a contract of sale of the ordered goods, to deliver to the Customer the goods for which the Customer has placed an order, to issue a document confirming the sale transaction of the goods, to store personal data in the IT accounting system to ensure the history of business transactions made through the Store.
The data are also processed by the entity Przelewy24 related to the execution of payment for the order.
In such cases the amount of data transferred is limited to the required minimum. In addition, the information you provide may be made available to the competent public authorities if required by applicable law.
The data administrator is not responsible for the provision of false or incomplete personal data by the Customer.
The Customer at any time, has the right through the Shop support office to change, correct or delete his/her personal data.
The Shop uses, among other things, the so-called “cookies”, which contribute to greater usability, functionality and ease of use of our store. These instruments also make it easier for customers to navigate the Store’s website more quickly. In addition, cookies allow us to measure the frequency of page views and the most viewed products. Cookies are small text files that are stored on your computer system. Please be advised that some of these files are transferred from the Store’s server to the customer’s computer system. It is possible to block cookies at any time, as long as the browser you are using has the appropriate function. Please note that after blocking cookies, the ability to use some of the functions of the Store will be significantly reduced or disabled.
§14 Final provisions
The Seller reserves the right to introduce and cancel offers, promotions and to change prices of products in the Store without prejudice to the rights acquired by the Buyer, including in particular the terms of contracts concluded before the change.
The Seller reserves the right to make changes to the Terms and Conditions. Contracts concluded before amendments to the Regulations shall be governed by the Regulations in force on the date of conclusion of the contract.
These Regulations are effective as of 16.11.2023.
These Regulations are made available to the Buyer free of charge prior to the conclusion of an agreement for the provision of electronic services and sales contracts. The Buyer has the opportunity to obtain, reproduce and record its content at any time.
All contents of the Store are subject to legal protection and their use will constitute a violation of the law.
In matters not covered by these Terms and Conditions, the provisions of Polish law, in particular the Civil Code and the provisions of the Act on specific terms and conditions of consumer sales and amendments to the Civil Code of July 18, 2002 (Journal of Laws 2001 No. 144 item 1204) the provisions of the Consumer Rights Act of May 30, 2014 shall apply. (Journal of Laws 2014, item 827, as amended); and other relevant provisions of common law.
